Muslim groups seeking to revive a lawsuit over a New York City Police Department surveillance program of mosques and businesses faced tough questions from appeals judges about terrorism and skepticism from an attorney for the city about the program’s very existence.

While much of today’s arguments before a three-judge panel in Philadelphia focused on alleged injuries to Muslim mosques, merchants and worshippers targeted by the program, judges questioned whether the NYPD’s response was appropriate in light of the September 2001 terrorist attacks and last week’s Paris shootings.
